Today, South Carolina lawmakers passed a law banning abortion after six weeks. Let’s be clear: This law will operate as a full abortion ban.
Most people don’t realize they’re pregnant until after six weeks. Think about it: that’s two weeks after your first missed period, if your periods are incredibly regular and if you are tracking them perfectly. Which is not likely!
And lawmakers who write six-week bans know this. They know because of Roe v. Wade they can’t say the quiet part out loud and just ban abortion, so they come as close to that as possible to implement what are essentially full bans.
The law also includes a provision that there is no exception for sexual assault survivors unless a doctor reports their name to law enforcement, even if the pregnant person objects.
Yeah, you read that right: The law requires doctors to out sexual assault survivors to cops if they want an abortion past six weeks.
Six-week bans never pass judicial scrutiny, as they’re an obvious example of an “undue burden,” which is the standard used by courts to determine if an abortion restriction is enforceable. (In actuality, ALL abortion restrictions are undue burdens.)
Today, @ReproRights and @PPFA announced they’re filing a legal challenge to the ban and a request for emergency relief—a fancy way of saying “make them stop this right now,” on behalf of providers in the state.
But this is just tip of the anti-abortion garbage fire. In the last two months alone, state lawmakers have filed over ❗️200 bills❗️ targeting abortion access. Half are full bans.
