This #lawtwitter news went under the radar. I applaud the PA Board of Law Examiners’ decision to adopt the UBE. Holding state specific bar examinations is meaningless in today’s practice. Increasing lawyers’ access to practice in different jurisdictions is a good thing. 1/ https://twitter.com/pacourts/status/1360314546557243392
I am hopeful, however, that this will be the beginning. Making prospective attorneys memorize and regurgitate laws and information bears no reasonable relation to the actual practice of law. It is an ancient and asinine way of licensing attorneys. 2/
The performance test portion is more applicable, but only counts for a small portion of the overall score. If we’re going to test candidates, the practical portion of the exam should be emphasized and expanded. 3/
And, the time has come to consider an apprenticeship program as an option for admission to the bar, rather than passing a test. I strongly believe that such a program could become a far better way of indoctrinating new candidates into the practice of law. 4/
Holding on to outdated and tired methods serves no credible purpose. Bar admission should evolve along with legal work. 5/ #lawtwitter
