With no running water, an ongoing electricity shortage, and the still-existent global pandemic hotel availability is incredibly limited and as we warm and people’s houses flood from busted water pipes, availability will continue to fall. 2/?
Reimbursement for something a person can’t acquire is an empty promise. But does anything surprise us at this point, when it comes from the BLE? In re: the make-up exam, it’s all good and well until you realize offering an exam on the an off date means forgoing the curve. 3/?
This is all to say that - once again - the BLE and SCOTX have the power to grant an equitable and fair solution for current February registrants. A one-time, emergency Diploma Privilege order would ensure that February takers don’t suffer unnecessarily. 4/?
The arguments haven’t changed here. There is just a matter even more pressing now than there may have been last summer. My future colleagues don’t deserve to be put through an exam during a global pandemic and this is especially true under the present circumstances in Texas. 5/?
The bar exam doesn’t test minimum competency. Now more than ever it tests how privileged and able you are to dedicate time to studying in the midst of a global pandemic, economic downturn, and presently - while water from busted pipes floods your electricity-free home. 6/?
“But they offer a winter exam every year in places with much worse weather”. Yes. Those places have much better infrastructure to handle their worse weather. Try again. 7/?

The NCBE has admitted the bar exam is a flawed measure. Countless practicing attorneys have agreed that it’s a hazing ritual and nothing more. We need to abolish the exam completely, but let’s take this one step at a time. 9/?
It all boils down to (while we’re at it, please refer to your local boil water notices) - The February takers deserve Diploma Privilege. The Summer 2020 takers did too, but it’s too late for them. We don’t need to punish future attorneys like this. 10/10
