1- The French Law Strengthening Republican principles that was adopted by the National Assembly is a very regressive piece of legislation that dangerously curtails civil liberties and human rights and freedoms.
3-I know what you are going to say: "yes but we need to fight terrorism". Well yes, but not by giving up on our basic rights & freedoms. The devil is *always* in the details. There is a gap between official announcements and what will actually happen once the law is enforced.
4-This law contains provisions that will affect the neutrality of public services, freedom of association, civil law rights, homeschooling and so on. I can already tell you that a couple of provisions violates the Constitution
(I'm thinking about how some amendments goes against what the Constitutional Council judged in this decision of of January 2017 https://www.conseil-constitutionnel.fr/decision/2017/2016745DC.htm).
Many amendments also, in my opinion, violates International private law as well as EU law and European law (spoilers alert: we are signatory to these international treaties and conventions so we are supposed to abide by them ;) )
The Bill is drafted broadly enough to be interpreted broadly, which in law is dangerous. It gives public authorities a large margin of appreciation that will allow them to restrict civil rights on the grounds of public order and the fight against terrorism.
IMO, this law does not provide any or very few safeguards to prevent such abuse of power from happening.
I would not be surprised that once the law goes before the Constitutional council for constitutional review, a bunch of its amendments will be deemed unconstitutional.
My take is that the Constitutional Council will declare the law partially constitutional, but again, I don't necessarily trust the CC on these matters so, stay tuned).
On February 4th, the French National Consultative Commission on Human Rights released its opinion on the Law Strengthening Republican Principles. In France, we already have a very strong legal apparatus (probably one of the strongest in Western Europe) to tackle terrorism. I mean, we literally codified state of emergency laws into the “Interior Security and Fight Against Terrorism” law to make them permanent
(yes it is as bad as it sounds).
Very few things in the Law Strengthening Republican Principles will actually tackle radicalization or prevent terrorist attacks from happening again. This law is basically mainly aimed at controlling religion (Islam mainly, but other religions will also be affected)
