The Enforcement Regulation is the framework the EU uses when it has won a WTO or bilateral dispute settlement case, the other country has not complied and it is necessary to impose countermeasures to induce compliance. To trigger it completion of the DS procedure was necessary
The original idea was to amend the trigger to allow act @Trade_EU to act if another country blocked dispute settlement. The immediate focus was on the blockage in the @wto where dispute settlement could be blocked by an appeal "into the void" 👇👇
But of course a similar situation could arise under the EU's FTAs, for example if a country refused to appoint an arbitrator or did not otherwise ensure that dispute settlement could proceed 👇👇
@EP_Trade and @EUCouncil accepted these changes but went further, following @MariePierreV, with important improvements. These include allowing @Trade_EU to rebalance commitments when a WTO Member withdraws services commitments (the existing regulation only covers goods)
The Regulation was also amended to permit @Trade_EU to apply countermeasures in services or intellectual property. Applying WTO rules on countermeasures to a large, diverse economy like the 🇪🇺normally implies that countermeasures be in the same sector as the challenged acts
So for @Trade_EU to have countermeasures available if it brings cases in the areas of services or intellectual property and hence ensure enforcement, the regulation was amended to allow countermeasures in services or IPR 👇
In potentially applying such measures, @Trade_EU will run through a series of cascading options 👇👇
@Trade_EU will undertake a review within a year to decide whether to propose in addition particular the possibility of additional measures in the field of intellectual property
@EP_Trade @EUCouncil and @Trade_EU also agreed that the Commission would develop an anti-coercion instrument to be proposed during 2021
