In December 2019 I arrested a drug driver. It was a very straight forward stop / investigation and he was found to be over the specified limit for Cannabis. As a result he was summonsed to Court for drug driving
The defendant pleaded not guilty and instructed a ‘specialist’ firm of drug driving solicitors that effectively guarantee to get you off the charge for a large sum of money - in this case estimated to be around £20,000
The defence did absolutely everything they could to be as obstructive as possible, contesting every possible aspect of the prosecutions case and causing me a huge amount of unnecessary and unreasonable work
One contested fact was that the defendant couldn’t possibly have had drugs in his system. This was despite the fact that when arrested he admitted to recently smoking Cannabis and when I searched him he had drugs in his possession which he admitted ownership of
During the time between the defendant being arrested and the trial, he was free to continue driving as he was not yet disqualified from holding a licence. This posed an obvious risk to everyone who used the roads
Last week I, along with 3 other prosecution witnesses gave evidence in the day long trial and am pleased to say that due to the combined work of the Police and @cpsuk, the defendant was found guilty and disqualified from driving
I am all for people having a defence, people can be innocent and mistakes are made. The vast majority of defence solicitors do their work ethically and professionally and I genuinely welcome their scrutiny. After all it ensures a fair trial which is so important
‘Specialist’ loophole firms which place a price on getting someone off of a charge jeopardise the safety of everyone who uses the roads
I’m pleased that in this case, and several of my other recent cases involving these types of firms, justice has prevailed and the defendants have quite rightly been found guilty despite their astronomical defence costs
I have no doubt these firms won’t feature these recent guilty verdicts on their websites. The only way not to lose your driving licence is not to selfishly drive under the influence of drink and/or drugs in the first place.
