This is what got Samuel von Pufendorf to call the Reich a "monster," since he was incapable of seeing the actual historically constituted political life before him without superimposing the fictitious juridical categories of early modern iusnaturalism.
This reminds me too that the phrase "imperium in imperio" is not an actual term of Roman law, but a neologism probably coined by Spinoza. Roman imperium absolutely was delegated as a matter of course, by the Lex Curiata of the curiate assembly.
