When it comes to US High School & even college level athletics, there's good reason to believe the discussion on a policy level has shifted:

The Biden EO & the proposed Equality Act both prohibit gender identity discrimination.
This gives room to argue that it is discriminatory to require a person, because of their gender ID, to undergo medical treatment (lowering T) in order to play.

Groups that are commonly asked to opine on transgender sports policy, like GLAAD, GLSEN, & NCLR (as well as The Center for American Progress), have all voiced support for the "All 50" policy model in high schools, which has no low testosterone requirement

The ACLU needs to be asked directly if, *ideally* there should be Men's & Women's categories, since they claim that sex is not binary, and sex is not identifiable.
If they support having Men's & Women's categories, they need to be pressed for their "why" and "how".
