Plaintiffs in the PSPP case filed a request for an order to implement the decision under Sect 35 of the Fed. Const Court Act in Aug 2020. 2nd Senate of the GCC barred the judge who replaced Pres Vosskuhle from participating, with non-disclosed no. of judges (plural) dissenting. https://twitter.com/sonderweg45/status/1359202022873038854

Three possible readings:

1. House of Cards in Karlsruhe. The majority in the 7 to 1 PSPP ruling takes no risk and makes sure that the new judge does not even get the chance to strengthen whatever opposition to the ruling fraction in the senate.
Then good luck for the next cases and the the working atmosphere in the court. Social distancing the Karlsruhe way.

2. The career judges were fed up with the media frenzy around interviews given by individual judges after controversial decisions and wanted to send a signal:
…stop the interviews. The case of the newby judge came in handy, but she was not the real target. After PSPP, even ECJ Prez Lenaerts turned to the media megaphone to respond.

3. PSPP (&, arguably, PEPP) will be thrown out fast and smoothly, & in order to quash any argument...
...pointing to a biased court, they move the new judge to the backseat.

The next PSPP decision and the PEPP proceedings will indicate the direction this is taking.

It doesn't get boring with the Second Senate. ///
