LETTER TO MY NC SENATORS
RE IMPEACHMENT TRIAL

The Constitution is clear. After Impeachment the Senate is to hold a trial. The constitution doesn't say that the trial can be omitted if the President leaves office.
2/
Further, the Constitution sets forth the 6th Amendment which gives citizens who are charged with a crime the Right of Confrontation. This preserves their right to plead "Not Guilty" and to present evidence in their own defense. This can only be done in a trial.

If Trump is denied a trial, he is denied his 6th Amendment Right to Confrontation which includes a speedy trial.

Mueller argued that the reason the Department of Justice didnt indict a sitting President was because it was their long-held opinion that a sitting President could not be prosecuted in federal court.

If he could not prosecute Trump then he could not indict Trump without violating his 6th Amendment Right to Confrontation, which includes a speedy trial. He felt it would be unconstiturional to Indict a president when a speedy trial would not be forthcoming

By the same token, once a President has been Impeached, it would be unconstitutional not to hold a speedy trial in the Senate.

It strains credulity that our founders would have wanted a President to have less rights guaranteed than a common criminal, so the 6th Amendment must apply to Impeachments as well. Trump must be tried.

It is unconstitutional to indict or impeach a person and deny them their Right of Confrontation. The sword cuts both ways. Once a citizen has been charged with a crime, the have a RIGHT to confront their accuser and submit evidence in their defense in a speedy trial.

Now, as your constituent, I expect you uphold your oath. I expect you to listen to the charges, hear the testimony, and review the evidence.

Then, based on the facts presented before you, I expect you to make a judgement as to Trump's guilt or innocence as to the High Crime he has been Impeached with.

If you refuse to consider the evidence, or if you make a judgement that is not aligned with the level of proof before you, I will consider your judgement to be partisan and not based on facts.

I will be watching the trial and I will observe the same evidence and see the same testimony. I will know if your judgement is aligned with the level of proof before you.

If you do not make a fact-based judgement, then I will consider you to have failed your oath to bear true faith and allegiance to the Constitution. I will know that you have instead placed your allegiance to your party or to your own power above your allegiance to the Nation.
14/
Unity starts with each person placing their allegiance to the Nation before all else.

You have a solemn duty. I hope you fulfill it. I will be watching.
