Teaching International Law with the Simpsons (or viceversa). A thread, open to your collaborations
In “Bart vs. Australia” [S6E16], the Simpsons visit the US embassy in that country, and Homer thinks he is coming and going from the US to Australia.
Consulates and embassies are not sovereign territory under International law. But this episode is useful to discuss territorial sovereignty and the inviolability of diplomatic premises.
“International waters” is not a technical term in the Law of the sea, so it could refer to waters beyond the "territorial sea" of any State or to High Seas. In any case, none of these are forgotten by International law [The Mansion Family, S11E12]
Even if they where at the High Seas, ships sailing there are under the jurisdiction of the flag state; also, when a ship is involved in certain criminal acts (e.g piracy) any nation can exercise jurisdiction under the doctrine of universal jurisdiction
The @CIJ_ICJ is portrayed in S22E1, but as a Court that could bring an individual to trial. They also imprecisely call it the World Court. The only correct thing is that, in fact, it is a court now using the building originally built to provide a home for a different institution
This quote is from “Bart the General” [S1E5]. JIB and JAB issues here to discuss.
One of the great legal advancements of the 1949 Geneva Conventions is that IHL still applies despite the absence of a formal declaration of war.
On the other hand, the UN Charter forbids the use of force to settle disputes, so you can’t wage war even if you declare it: it would be an act of aggression.
In S7E23 Apu, the operator of the Kwik-E-Mart, risks being deported after Mayor Quincy pass Proposition 24 to decide on (illegal?) immigrants (the referendum was approved by a 95% vote). Great episode to discuss nationality, citizenship, immigration, deportation, non-refoulment..
I bet there are lots of other episodes and themes to discuss. I welcome your contributions. What do you say @LeopoldoGodio @pedrocaminos @EtkinBasak et al?
