Man who abandons Islam and FIGHTS against Allah and His Messenger

(فَيُحَارِبُ) (الْمُفَارِقُ لِلْجَمَاعَةِ)
Treaty of Hudaybiyyah:

allowing Ex-Muslims the right to leave medina and live in Mecca without being killed for apostasy!
"Whoever changed his religion, kill him."

Narrated by "Sahih al-Bukhari"
But not by "Sahih Muslim" because he doesn't take hadith from "Ikrima ibn Abi Jahl"

The death punishment only include those who apostate then leave the Muslims and join another group that is fighting the Muslims

To my understanding this verse is talking about apostates :

"So if they remove themselves from you and do not fight you and offer you peace, then Allah has not made for you a cause [for fighting] against them."
As for the scholars' opinion

the majority argued for a death penalty to a male apostate.
As for a female their was more disagreement, as some thought that a female have been excepted from the "death penalty".
Did the prophet ever apply the death penalty to an apostate?

He did apply it, but in every case their was something more than apostasy going on.

like being involved in a murder, or fighting the Muslims in battles
is the apostasy law considered to be a "Had" "حد" ??
