The Lincoln Project should not threaten to sue Rudy Giuliani, let alone sue him, for his psycho claims that they promoted the domestic terrorism at the Capitol on 1/6.

Here’s why.

/2 Someone needs to be the grown-up in the room. Someone has to do the right thing. Someone has to be patriotic, to show fidelity to American values.

It won’t be Rudy or the people who support him. It should be them.

/3 Performative litigation is a scourge. Suing as a vehicle of politics, suing to pwn the other side, suing to fundraise, suing to preach to the choir — these things are a cancer. They are particularly destructive when used to attacked speech.

/4 Bogus politically motivated defamation suits are now common. People who nominally support free speech support them, so long as they attack the Other Side. Sleazy, amoral attorneys file them, and partisans cheer.

/5 Now, Rudy. Rudy is a demented fascist. But here’s the thing: Rudy’s unhinged allegations about @ProjectLincoln doesn’t damage it a bit. No human will change their minds about LP based on his words. Everyone moved by those lies already hated LP. It was pure base-pandering.

/6 Never mind whether you could prove that these false statements were uttered with actually malice. There is no need to — and no excuse for — suing political performance artists for bullshit that doesn’t hurt you. It contributes to the performative litigation culture.

/7 Lincoln Project is not Dominion. Dominion was economically devastated by lies. LP will only gain followers and money from them. The only reason for them to sue would be cynical fundraising and virtue-signaling.

/8 Here’s what the LP could do to impress me. They could call Rudy out as a buffoonish liar, but say they won’t be suing him, because nobody redeemable or worth knowing believes him or cares what he says, and they aren’t a dishonest vexatious litigant abusing the system like him.

/9 The court system is not your LiveJournal page, all you partisan misfits. It’s not a podium to rile the mob. It’s not even a weapon to punish the morally despicable.

Stop abusing it for attention.
