Section 108 of the Environment Act 1995, but make it like a film.

When you work for a local council, it’s very rare that you get the opportunity to feel like an action hero.

(That is, until @MarvelStudios decides to release a new film called ‘Assessing Planning Applications Man’, but so far they’ve ignored our letters)
Recently, though, one of our Enforcement team members turned into a prime Liam Neeson.
After complaints of this fly-tipping, and a thorough investigation, our officer had a clear idea of who the offender was.
The person in question then admitted to the offence via email – job done, you might think!
The problem is, this individual then refused or ignored requests to complete the relevant paperwork or attend an interview. BIG mistake.

Do NOT come between a council and its paperwork.
Evidence suggested that this person had fly-tipped this waste for his girlfriend. The pair moved house and seemed to have fallen off the radar. The chase was on.
After a while, our eagle-eyed officer spotted the suspected fly-tipper’s girlfriend at a supermarket with a man – could this be our guy?
He approached them both, questioned them and, YES! He’d found him.
The person was served a Section 108 notice, meaning he couldn’t ignore requests for an interview any more.
Once this notice was breached, it meant the case could go to court. The man was fined £440 and £548 costs.
The moral of the story? Don’t ignore our letters.

Our Enforcement team has a particular set of skills – skills they have acquired over a very long career. Skills that make them a nightmare for fly-tippers.
They will look for you. They WILL find you. And they will…

potentially issue a fine or serve you with a similar notice if the situation calls for it.
