1/ A plea to all fellow employment lawyers. We are all struggling with the challenges of lockdown. My instructing solicitors are all still getting to grips with the brave new world of preparing for CVP hearings in a way they would never have had to before...
2/ ...putting a huge amount of effort into hyperlinking indexes and paginating and repaginating thousands of pages of document just to make sure they are as easy as possible for Judges and Counsel alike.
3/ At the same time, lots of us are trying to home school children, look after elderly relatives and just survive lockdown. So please, please, please be kind to your opponents.
4/ Don't take measly little points with them. Don't lumber them with late disclosure or make unreasonable requests just because your client wants you to. Don't be critical about genuine errors in bundles, or threaten them with costs applications.
5/ At an ELBA session some years ago, I remember Jennifer Eady, now Mrs Justice Eady, stressing the importance of just being kind - to litigants in person, to opponents, to Counsel who appear before you. It has stayed with me. Let's try and remember that.
6/ We are all in this together. Be kind.
