Biden cancelled the presidential permit needed for cross-border projects. Only he, not Congress or the Courts, can grant that. Obama had rejected it while Trump approved it but w/ the caveat it could be rescinded.

TC Energy+supporters are hoping Biden will change his mind by viewing the pipeline as progressive. They say the pipeline creates jobs+is safer than transporting oil by train or truck. The project will use union labor+renewable energy and have net zero emissions.

The day after TC Energy sent out a newsletter with this framing and asked supporters to contact their legislators about this, SD's Congressional delegation sent a letter to Biden rehashing these talking points. See the article for links.

Opponents now want to shut down the Dakota Access+ Enbridge Line 3 pipelines and will continue to fight the KXL Pipeline if it doesn't go away. They will be involved in other climate justice issues and pushing tribes to adopt fossil free energy.

TC Energy is likely deciding whether to scrap the project or hope for a new president in the next four years since it’s not likely to change Biden’s mind or find success in the courts, according to two professors at the University of South Dakota.

Presidential decisions can't be challenged through administrative+procedural laws like permits issued by state+ federal agencies. TC Energy may not even be able to sue for economic loss since they took the investment risk knowing the presidential permit could be rescinded.

Opponents are opposed to this and other projects for several reasons:

➡️ Environmental concerns
➡️ Tribal sovereignty+consent issues
➡️ Worries that large groups of mostly male workers will bring an increase in crime to rural+reservation communities

8/x
Indigenous people and nations stress that these issues are deeply connected. They all relate to the overall issues of sovereignty and safety (for the earth, people, etc).

9/x
To expand on the tribal sovereignty concerns. These projects pass through land promised to Indigenous nations in now-broken treaties. They pass very close to reservations, over water sources and possibly over some off-reservation trust and mineral rights land.

This story has reactions from:

➡️ Gov. Noem
➡️ SD's congressional delegation
➡️ TC Energy
➡️ Two professors (law+politics)
➡️ Two Indigenous activists
➡️ Three SD tribes
➡️ Four SD-based or focussed nonprofits

Supporters of the project say that all the environmental and other studies+permits (except the presidential one) have been approved. Opponents argue the studies were flawed rushed, etc.
