Judge Tipton ends this morning's hearing without ruling on Texas request for a temp restraining order to halt the Biden admin's 100-day moratorium on most deportations. Tipton wants to know if ICE email reported by Tucker Carlson -- supposedly saying "release them all" -- is real
Tipton did not seem very familiar with the complexities of the US immigration system, and has asked the govt to provide, on short notice, many of the same stats we've all been after, such as: how many of those who are released by ICE show up for EOIR hearings?
At one point Tipton asked whether govt and state of Texas would proceed with expedited discovery. The govt attorney said it would be "outrageous," arguing Texas has no jurisdiction over DHS's discretionary power to enforce US immig law
