Pleased to say that I sued PPB for battery after they shot me with a foam bullet in June. They offered $2,500 which I accepted. No NDA, no deposition. Lot of other people got tagged and imo lawsuits should be part of our toolkit. Here's what you can expect.
An attorney can tell you more, but OR has a provision that allows you to sue officers for battery for up to $10,000. As I understand this is an end run around QI. Some attorneys do this on contingency: fees are included in the settlement; no settlement, no fees.
Note: this statute doesn’t allow you to sue feds. However, you may be able to sue PPB for federal action under their direction. From how last night seems to have gone, it might be worth considering.
Doesn't mean that is risk free. In the event that case went to trial, there is a possibility that the City could try to get expenses awarded, to the tune of around $1500-2000. At least that's my understanding of my specific case. Again, your attorney will know more
I don't know exactly what kind of pressure this puts on PPB. It doesn't come out of their budget directly, but I hope these settlements are more leverage for actual defunding. Gotta admit my reasoning was basically "fuck me? No, fuck you" after getting hit with enough batons
But I think this is a good next step for a lot of activists and people shouldn't be intimidated by the process. That money can directly fund a lot of cool shit and continue to grow the movement.
I was represented by Troy Pickard who was great and donated his fee to ACLU. Told me cops tagged him with a rubber bullet protesting when he was younger. I had a very good experience working with him.
Final note: $2,500 is total settlement offer. Troy very generously only took a $500 fee, which he donated. I'm planning to match that donation, although I haven't decided where yet. I'm out of work at the moment so the rest will go to rent and stuff.
