THREAD: I'll be posting updates from this afternoon's federal court hearing in United States v. Mark Sahady below. Sahady faces 2 charges related to his role in the Jan 6 Capitol events.

The hearing is starting now.
Sahady has opted to have his preliminary (probable cause) hearing in the District of District Columbia.

Judge confirms govt is withdrawing motion for detention.

Now we will hear about proposed conditions.
Government is asking for a number of conditions, including barring Sahady from going near the State House.

Sahady is charged in the federal court, District of Columbia district. This hearing is being held in Massachusetts.
Sahady's private attorney just said it would be helpful for the federal (court-appointed) attorney to stay "to help". Judge had to inform Del Gallo that Sahady isn't entitled to a court-appointed attorney, since he's hired a private attorney.
"I'm having problems with Pacer," says Ronald Del Gallo.

Del Gallo couldn't file the documents, and had to have someone file them for him.

It's his first time using Pacer.
Another individual had to file them for Del Gallo. Judge asks Del Gallo not to do this again. Del Gallo claims "the [Pacer] system doesn't mechanically work".
The govt is recommending restricting Sahady's travel to staying inside Massachusetts and DC only for court hearings.

Del Gallo says it's infringing on Sahady's rights, and says "even going skiing in Vermont."
Govt is also asking Sahady to not be in contact with any victims, witness or related defendants. Del Gallo says this is too broad and argues there's no one real victim.
Government has asked for Sahady not to throw any rallies or demonstrations without permission from probation. Del Gallo opposes that. Del Gallo also says he opposes request that Sahady stay away from Massachusetts State House.
(So far, Sahady would like to be released and continue to potentially visit the state Capitol and or throw a rally there.)
Del Gallo says the government is attempting to "silence Sahady from voicing support for Donald Trump".
Del Gallo says the government is asking for conditions that would entail Sahady would have his "lips taped".
"The reason they don't want him to go to the State House is they don't want him to voice his opinion," Del Gallo says. "They don't want him to talk about Trump or an election that's not fair."
Judge interrupts Del Gallo, government's turn.

Govt says there is no attempt to silence Sahady's support of the president.

Defendant was part of a group that engaged in "riotous activities ... that resulted in five deaths, including that of a police officer."
Government says yes, conditions of release commonly touch upon constitutional rights. Govt says the conditions are designed to "preserve and protect public safety."
Judge rules against Del Gallo, says she will impose all conditions.

"If he doesn't agree to these conditions, he will not be released."
Judge: "No one is saying Mr. Sahady can't in other ways voice support for Mr. Trump or any other candidate."

Judge says to Del Gallo "I had a lot of trouble understanding your pleading. Your arguments were somewhat unintelligible."
Travel restricted to Massachusetts or DC, for court purposes only. Judge advised Sahady to request permission to go skiing in Vermont from probation.
Will have to surrender passport. Judge asks if 24 hours is enough. Del Gallo says Sahady might need three days.
Sahady will be required to turn in passport on Monday.

Sahady will be required to hand over firearms, including those belonging to other individuals in household. (His mom).
Sahady will not be allowed to organize any rallies/protests, etc. without permission from probation.

Sahady will be required to stay away from Boston State House.
If I understand this correctly, if you run into Mark Sahady at a Vermont ski mountain, you have probation to blame?

Del Gallo to judge, in response to whether his client understands the conditions being imposed by the court:

"Yeah, we might appeal the first amendment stuff."
The next step would be for Sahady to be picked up from jail. He would have a probable cause hearing (via Zoom) in the DC district.

Del Gallo ends by calling Pacer "a monster."
