Ok, so here's what I understand and what I think about the 100-day moratorium on deportations:
1. It asks for a review of DHS policies around immigration enforcement. Due in 100 days.

People who fall in these categories are priority: National Security, Border Security & Public Safety. My concern here are the folks who are just trying to migrate and are apprehended at the border.

A lot of people in our undocumented community who work to provide and are apprehended, get felonies. People who are caught with pot. Can go on. It’s really going back to the “we’re deporting felons” rhetoric, and doesn’t take into account the broken criminal justice system.
3. 100-day pause on deportations while the review happens. Starting January 22nd. Moratorium does NOT apply to this category of folks.
Asks for a process to review people with orders of deportation to see if "alternatives to removal" may be appropriate. Includes reopening cases, alternatives to detention, custodial detention, etc. My worry is the detention part. People should not be waiting in detention. Period.
In general, it absolutely is progress, and it speaks to the work that we have done to push back against deportations. We have more tools to advocate for our community to not get deported. The caveat is who gets leveled as a felon under the law,...
... the folks who are just trying to cross the border to seek a better life (they will deported right away I believe) and more people ending up in detention for longer. Also, apprehensions are not stopped. So yes, ICE can still detain people. During the COVID-19 pandemic.
We have to keep pushing and telling the stories of those who will be targeted by ICE no matter what this memo says. At the end, ICE and CBP will still be tasked with enforcing all of this. We have to stay vigilant. I don't trust those guys. Pero bueno. La lucha sigue!
