Now that @POTUS and @VP are in, and Biden has stated he’ll be signing EOs to undo some of the harmful immigration policies of Trump, I’m going to be tweeting out short bits on those policies, & what the EOs will (hopefully) start. #Immigration
There is a lot to unpack, but hers a good start. https://www.npr.org/sections/inauguration-day-live-updates/2021/01/20/958626092/on-immigration-biden-goes-big-in-opening-bid-to-congress
First, let’s review #DACA. An EO signed by Obama, allowed certain young ppl, brought to US as kids & meeting other reqs, to have relief from deportation....
DACA is not: path to citizenship; legal status in the traditional sense; permanent.
DACA is a type of grey zone (like TPS). Allows employment auth, relief from deportation, but it’s temp & must be renewed.
Trump tried, on multiple occasions, after lawsuits failed, to get rid of DACA via policy. Recently, A court shot down a Trump attempt citing Wolf’s lack of authority as the acting director outside his authorization. See: https://www.nbcnews.com/politics/immigration/federal-judge-rules-acting-dhs-head-chad-wolf-unlawfully-appointed-n1247848

So: what is Biden saying now re: #DACA and #DREAMERS? Well, it’s what immigrant rights activists have been fighting for since the first proposed DREAMAct. A path to citizenship for ppl who were brought here as kids. Ppl who are American in every way & that will be recognized
Another big deal, which ppl outside of #immigration might not note: changing the legal language. RN, we use the term “alien” as it is a legal term in INA & regs. #Biden said he will change it to “noncitizen”.
And changing the word “alien”, which implies otherism & a less than equal outlook, to “noncitizen” which accepts the humanity of another, in our legal language, is both a legal & psychological shift.
