Prosecutors alleged that the man who appeared shirtless wearing horns on the Senate dais during the siege participated "in an insurrection attempting to violently overthrow the United States government," its strongest language so far describing last week's unrest.

One piece of evidence they point to: Jacob Chansley, the shirtless man photographed wearing horns standing behind Mike Pence's desk left a note for the vice president warning: "it's only a matter of time, justice is coming."
One thing to consider: If DOJ thought Chansley or others were trying to kidnap or kill people, or overthrow the government by force, there are specific and very serious charges it could bring. So far, it hasn't indicted Chansley or anyone else for those things.
