1/ In yesterday's paper, B'tselem says: "The Israeli regime’s rationale, and the measures used to implement it, are reminiscent of the South African regime that sought to preserve the supremacy of white citizens." Here, we explore those similarities.
2/ We also agree with B'tselem that Israel does not need to mirror apartheid South Africa in order to meet the legal definition of apartheid under international law. While the parallels are compelling, each case is unique.
3/ The crime of apartheid is defined in int'l law as inhumane acts "committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over any other...with the intention of maintaining that regime" (Rome Statute of the ICC).
4/ "Racial discrimination" in int'l law is not limited to skin color. It includes "any distinction, exclusion, restriction or preference based on race, colour, descent, or national or ethnic origin" (Int'l Convention on the Elimination of All Forms of Racial Discrimination)
