So let’s talk conspiracy. Conspiracy laws in the US generally require:

- two or more people
- coming together to agree on doing something
- and an overt act*

*some laws, notably drug laws, don’t require this https://twitter.com/emptywheel/status/1348638197849452545
Broadly speaking, not every person in a conspiracy needs to know every other person in the conspiracy.

Also sometimes all it takes is for one person to take an overt act
So what this means for you is you can’t outsource criming. If you conspire with me, and I conspire with a third person, and that third person commits the act, we’re all in the conspiracy together
So if I were, say, a white house official in contact on behalf of the POTUS with one of the people who stormed the capitol, boom, that’s all of us altogether
Or at least that’s the theory. It generally waters down a bit in court. See for instance the RAM cases.
Anyhow, while pipebomb bro would likely be able to further build a case, he is not necessary to build a case.
Anyhow, i’m not a lawyer etc etc don’t use my advice to get out of crimes but DO read up on crimes so you stay five steps ahead of the feds at all times, k?
Janice points out that it can still be conspiracy without an attempt! (But clearly we have acts on Jan 6 anyways) https://twitter.com/jlrlaw/status/1348699751827517441
