We may want to protect the character because we feel affectionate towards the stories that have been told about him. But sometimes icons get stolen from us. Try incorporating the Buddhist swastika into your jaunty t-shirt design - it can't be done.
And the thing is... I don't feel that this character and his iconography were stolen. We in comics gave it away. When Edmondson et al made him a mask wearing militia nutcase, when Gerads designed the punisher badge for Chris Kyle, we gave Frank Castle over to the worst people.
