My lawyerly instincts won out over my better judgement and I've reviewed many videos the insurrectionists captured of themselves

Here's what I think: charge them all
Yes, charge them with knowingly entering or remaining in any restricted building or grounds w/o lawful authority in violation of 18 USC 1752(a) and violent entry and disorderly conduct on Capitol grounds in violation of 40 USC 5104(e)(2) – but for those who really made it happen?
Those who really made it happen should be charged with seditious conspiracy in violation of 18 USC 2384.

Convictions shouldn't be hard to get because you can hear their confessions on their own damn livestreams.

You do .not. need to watch the videos in order to be an informed American.
Seditious conspiracy carries a penalty of up to 20 years imprisonment.
