Supreme Court justices had private conference this morning, so we could get grants today. Lots of big stuff on conference list - abortion, PA election case, etc. - but odds probably against any blockbuster grants today given combo of past practice and impending inauguration.
To spell that out, the Trump administration has pending appeals involving emoluments, public charge rule, abortion counseling. All could become moot when or shortly after Biden takes over.
Abortion case involves Mississippi's 15-week ban and could gut 1992 Casey decision, which said states can't significantly restrict abortion before fetal viability. Court repeatedly rescheduled case starting in late Sept. It was formally before justices for the first time today.
Also in the mix today: Two appeals challenging the PA Sup Ct's 3-day extension of the ballot-receipt deadline. Too little and too late to help Trump, but Scotus conservatives have indicated they want to restrict state court power to reshape presidential election rules.
