THREAD: @EPA has been rushing its last minute rollbacks to get them "on the books" before Biden comes in by overreaching and claiming "good cause" to make the rollbacks effective immediately. But EPA knew it didn't have the legal basis to claim "good cause." How do I know?
Because when @EPA sent OIRA the #censoredscience rule for review, @EPA said the rule would take effect in 90!! days NOT immediately. Of course it was changed to effective immediately because @EPA and Trump Admin realized they were running out of time after Trump lost
So @EPA claims the #censoredscience rule is just "procedural" so it must take effect immediately. But when @EPA sent the rule to OIRA it also said the rule is just "procedural" but said it takes effect in 90 days. How does that add up? It doesn't.
IMO this is such a deliberate abuse of the APA's "good cause" exemption that Congress should investigate and the Biden Admin should consider ways to reverse @EPA's ham-handed attempt to rush these rollbacks "on the books"
