Many people have no idea about this term, others don't believe in it as they think that signature on Nikkah-Nama is a consent of both husband and wife, and women is obliged to her husband when he asks for sexual intercourse (with or without consent).

The Women Protection Bill describes rape as:
"A man is said to commit rape who has sexual intercourse with a women under circumstances falling under any of the five following descriptions,
1. Against her will
2. Without her consent
3. With her consent, when the consent

has been obtained by putting her in fear of death or of hurt
4. With her consent, when the man knows that he is not married to her and the consent is given because she believes the man is another person to whom she is or believes herself to be married

5. With or without her consent, when she is under sixteen years of age."
So marital rape can fall under any of these categories except for no. 4, but the problem is that it isn't explicitly stated.
Marital rape cases don't get reported

Islamic Scholars describe that marital rape occurs when the man asks his wife to have sexual intercourse during her menstrual period or in an abnormal sexual position or during fasting hours in Ramadan. God gave women the right to refrain from her husband as God says

"And they ask you about menstruation. Say, it is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves,then come to them from where Allah has ordained for you. Indeed, Allah loves those who are

constantly repentant and loves those who purify themselves" 2:222
The Islamic Shari'ah advised that the sexual intercourse between man and wife should be conducted with intimacy and love and made such amicable conduct as a sign of piety. God says in Quran,

"Your wives are a place of sowing of seeds for you, so come to your place of cultivation however you wish and make an introduction of yourselves. And fear Allah and know that you will meet him. And give good tidings to the believers." 2:223

Prophet S.A.W said,"Three things fall under the unkindness and one of them is when a man engages in sexual act with his wife without sending a messenger: humor and kisses. No one should directly fall on his wife like one buffalo does to another" Hadees narrated by Anas-ibn Malik
