Re the doc from yesterday, in VERY basic terms, AH counter-sued JD on a number of grounds. JD filed âdemurrersâ in response to her claims... which are objections stating why each claim should be dismissed now rather than proceed to trial...
The letter yesterday upheld most of JDâs objections and dismissed several of AHâs claims. The judge has also said that her counterclaim for defamation canât be dismissed at this stage... it will be fought out at trial.
He also (in very basic terms) said neither of them have immunity under anti-SLAPP laws.
Re AHâs defamation counter claim, a number of claims WITHIN it were deemed out of time so the extent of her counter-suit is reduced.
So JD won all but 2 points and it is positive for him. The decision to allow her to proceed with her defamation claim isnât necessarily bad as it means she has to actively prove her claim... prove her lies essentially.
So while itâs not perfect (these things rarely are!), itâs still a much better outcome for JD than AH.
