Yesterday Judge Jeremy Kernodle dismissed @replouiegohmert & select other Republicans that Sought to endow Pence with the legal authority to effectively overturn the fraudulent 2020 election. Another Trump appointed judge hiding.
Kernodle said the GOP plaintiffs lacked "standing" because Gohmert suffered no "legally recognizable injury." What a crock of shit. If you are a voter & you vote & you're robbed of your vote by fraud you can't sue to protect it ever? Not before an election & not after? WTF???
If you remember suits were filed before the election challenging election rules being changed without legislation as designated by the Constitution, those cases were dismissed stating no "standing" because no recognizable injury, now after same thing? Whiskey Tango Foxtrot???
Our most important right is the right to vote, and based on the actions or rather the inactions of these coward judges, that sacred right is gone. in Marbury v Madison 1803 it established the founding principle of judicial review in the US.
In other words American courts have the power to strike down laws, statutes, & government actions that they find to violate the Constitution of the United States. Marbury remains the single most important decision in American constitutional law
Marbury is the lynchpin that the balance of power hindes on that keeps the balance of the three branches of government equal. Lack of standing isn't even a Constitutional concept, but was invented to water down the law process post Marbury.
These coward judges are trying to have it both ways hiding behind standing before and after the election. Stating there was no injury suffered is bullshit, there are 74 million plus that suffered damages by allowing this fraud to go uncontested, not even reviewing the facts
Standing is a made-up doctrine for courts to hide from their duty to interpret the Constitution, a duty they claimed unilateral & final authority over. Andrew Jackson warned us to ignore the courts when they ignore the Constitution.
Think about who's portrait famously hangs above Trump’s desk in the Oval Office. The communist left hates Trump and they equally hate Andrew Jackson. Us Texans love "Ole Hickory" Andy Jackson, because he's the reason we exist.
Our founding father Sam Houston fought under the command of Andrew Jackson in the War of 1812, and was his political mentor. It was Jackson who inspired Houston to go off to Coahuila y Tejas, and build a republic called Texas.
In Worcester v Georgia 1832, SCOTUS sided with Native Americans and ruled against white settlers who sought to remove them from their land. Jackson refused to enforce it & told the Court, “Chief Justice Marshall has made his ruling, now let him enforce it.”
Marshall did not take Jackson up on his offer and the order was never enforced. Fast forward to Abe Lincoln & his decision to suspend the writ of habeas corpus, one of the most critical civil liberty protected by the Constitution.
Chief Justice Roger Taney, ruled that only Congress, not the President, could take such constitutional action. Lincoln refused to enforce the Supreme Court order and was never challenged.
Point being there is precedential basis for President Trump to disobey an order from the Supreme Court, in fact there is no provision in the Constitution which expressly grants the SCOTUS the right to invalidate state or federal laws on the basis of constitutionality.
In fact, the Federalist Papers makes it clear that such power of review was never actually accorded. Alexander Hamilton stated in Federalist 81, that SCOTUS was not granted such broad powers outta concern that it might exercise “Monarchical” authority.
Unfortunately, the SCOTUS in Marbury v Madison, did an end run around the Constitution by giving itself the power to declare acts of the Congress or president unconstitutional and establishing the doctrine of judicial review, a place to hide, when they don't want to act.
So the Courts especially the SCOTUS love to hide behind Marbury v Madison and refuse to consider legal arguments on touchy subjects with bullshit terms like Standing, which has no legal foundation at all, it's invented as a blind to avoid conflict.
All arguments properly formatted and presented to the court have "standing" and deserve to be heard. Judges however to avoid having to make a controversial decision, hide behind their crap like "Standing" which they've exercised multiple times in the election fraud cases.
. @realDonaldTrump has the authority based on prior precedent and the original intent of the Constitution to decline enforcement of SCOTUS decisions. If he gets frustrated in the coming days, I recommend that he turn around & take a good look at the portrait of Andy Jackson.
