Mike Pence was actually *sued* [in a friendly way, of course] to establish that the 12th amendment should guide the Jan. 6 proceedings and not Section 15 of the conflicting Electoral Count Act of 1887.

The Gohmert, et al. suit in District Court follows below:
'This civil action seeks an expedited declaratory judgment finding that the elector dispute resolution provisions in Section 15 of the Electoral Count Act... are unconstitutional because these provisions violate the Electors Clause & the 12th Amendment of the U.S. Constitution.'
"This violation occurs because the Electoral Count Act directs the Defendant, Vice President Michael R. Pence... to count the electoral votes for a State that have been appointed in violation of the Electors Clause"...
"(2) limits or eliminates his exclusive authority and sole discretion under the Twelfth Amendment to determine which slates of electors for a State, or neither, may be counted"...

In summary, we are heading into virtually uncharted waters. The American People should let the Constitution be their guide, and not their preference on whom they 'feel' should be the presidential winner.
