Hampshire LEA is already doing this after threatening a CEV parent at a fines panel meeting. A team of lawyers from the Public Interest Law Centre turned up in support and new guidelines were issued the following day to revoke previous fines and to support learning.
Other heads have to followed suit after reading the government response (that the decision is down to the heads).

Unfortunately official DfE guidance still remains that only CEV children are supported and CV/CEV parents (who may be more at risk due to age related risk) aren't.
