New data came out today on federal prosecutions, and it's filled with new numbers on the failed War on Drugs on the federal level. This should provide a roadmap for how a Biden administration can begin ending this disastrous waste of government resources. Some highlights: 1/6
For the year reviewed by this new report, 17,072 people were under federal supervision for drug possession alone, in the form of probation, parole or supervised release, and 94,163 people were in federal prison for drug offenses. 2/2
There were 2,159 defendants in federal court for drug possession alone. Remember, Biden has said no one should be incarcerated for drug use alone. If this is the highest charge available, right there these thousands of cases should disappear. 3/6
Federal prosecutors declined to prosecute only 17.2% of drug cases. Compare that to declining to prosecute 40.3% of tax law violations, or declining to prosecute a whopping 85.1% of civil rights cases. Biden will have direct authority over AG to direct him/her 2 decline cases 4/6
Only 1 of the 2,133 drug possession cases that were terminated in federal court involved a jury trial. ONE. 99.5% of federal convictions for drug possession were result of a guilty plea. This isnt a system of justice, it's a plea mill, as observed by Justice Kennedy years ago 5/6
Of those sentenced for drug possession in federal courts, 76% were sentenced to incarceration. This is nuts, and again an area that a Biden-Harris administration can fix immediately and unilaterally.
