John Eisenberg has likely been the target of a CI investigation for the past 4 years opening the door for surveillance of West Wing activities and comms.
26 Jan 17—WH Counsel, Don McGahn, meets with Acting AG, @SallyQYates, and her deputy, Mary McCord. McGahn tasks Eisenberg with conducting preliminary research into the Flynn situation.
27 Jan 17—McGahn meets with Eisenberg to discuss initial findings. McGahn also meets again with Sally Yates later in that morning. McGahn requests access to the Flynn-Kislyak transcripts.
28 Jan (Saturday)—Eisenberg is working w Flynn in the NatSecAdvisor’s West Wing office. Eisenberg walks back to his office in the Executive Bldg. Later, an assistant shows up at Eisenberg’s office holding 2 cell phones. Eisenberg “mistakenly” takes Flynn’s cell phone.
Eisenberg unlocks the phone and sends an email to Mary McCord at around 5:30 pm. He is trying to set-up a secure call the next morning. (Eisenberg later reports that Flynn and he share the same passcode!!! Sally Yates suggests it used a thumbprint!!!)
McCord is confused to see an email from Gen Flynn’s email account and hesitant to respond. McCord gets Eisenberg’s email address from a WH FBI liaison to contact him.
Eisenberg immediately responded to McCord’s email from his email address. (Presumably he was using his desktop to respond, otherwise how would have received the email if he only had Flynn’s phone.)
Questions:
1.Why wouldn’t the assistant first ask Flynn which phone is his instead of walking from the West Wing to the Eisenhower Bldg.?
2.Why wouldn’t Eisenberg send the email from his desktop computer when he was sitting at his desk?
3.Did Flynn really send the email?

4.Did Eisenberg send the email in the presence of Flynn?
5.Would the FBI not look into the guy who just emailed the DOJ using the phone of a man already under both CI and criminal investigation after stating he will be “handling the Flynn matter from this point on”?

Obviously, the DOJ/FBI would be asking these questions after McCord started sharing this strange story? It's impossible to dismiss that fact. Remember, DOJ/FBI are trying to get Trump!!! They would never let this go.
CONCLUSION: The only way Eisenberg could have done something so stupid is that he’s incompetent and shouldn’t be anywhere classified information… or he’s trying to gather intel for Flynn… or he is intentionally trying to put himself on the FBI’s radar so they can spy on Trump.
