1) SEC vs Ripple is about one thing. Raising capital from the general public. If you are raising funds for any from general public you have to register as a security. This isn’t only selling stocks. Cryptos work around has always been only sell to institutions and qualified inv.
2) SEC is going to argue that ripple sells to “institutions” but the reality of the setup is a mechanism to flow those assets to retail investors. This would be an issue for all crypto trading in the USA.
3) While Jay Clayton is a reptilian looking prick that’s not why Ripple is being sued. This lawsuit will set the regulations for digital asset trade in the United States. Who are they gunna drag into court Chinese Bitcoin Miners or the Eth Foundation.
4) The government has to worry about a pandemic and financial issues of historic proportions. Some nobody congressperson or senator you’ve never heard of isn’t going to roll out crypto legislation we need. Courts are the only way at this point and crypto is too big 2 not act now
5) This case had to be signed off by multiple people at the SEC and the litigating attorney. Maybe a new administration squashes this but not likely. It has to happen and unfortunately Ripple and XRP holders bear the cost for now.
SEC has publicly stated they believe XRP is an illegal security in the US and they are holding both businesses and individuals responsible for its trade. If your exec of Coinbase, Uphold or any exchange servicing US customers what would you do? I think we know what’s coming
7) I don’t believe they wanna kill off Ripple, XRP or the crypto market. They do want rules for people raising funds in US and this is our course. It’s unfortunate but a reality. Throw every issue at them and let the courts decide.
8) I will continue to hold every XRP I have acquired even though I know we are walking into a short term buzz saw most likely. This is our Mt Gox moment in many ways but I believe we will finally put all of this behind us.
9) From this we will have real rules. What is legal what is not. What needs to be done to sell digital assets to retail, what can founders take as compensation, who can hold the crypto as the ecosystem grows.
