NEW FROM ME: The White House’s lame duck rulemaking rush has included a bevy of regulations that widen the lanes for religious employers -- sometimes while using federal money -- to hire and fire on faith-based grounds, over the strident objections of civil rights groups. 1/
It’s part of a comprehensive effort to infuse "religious freedom" principles across federal agencies, especially in the wake of SCOTUS’ decision in Bostock vs. Clayton County that forbade employment discrimination on the basis of gender identity and sexual orientation. 2/
But even some religious groups say that these new rules could make life harder for members of smaller faiths, since Christian institutions tend to be the largest employers and recipients of government contracts -- not to mention LGBTQ and disabled people. 3/
They’re particularly worried about a fast-moving revision to the EEOC’s religious discrimination manual for employers. The last update process took years; this one just popped up and was advanced by the GOP Commissioners over pleas from the minority for more time. 4/
While this guidance doesn’t have the legal force of regular rules, it will influence workplace practices -- and can’t be rolled back right away, since the first vacancy on the GOP-dominated commission comes up in 2022.
