Thread: I can't stop thinking about January 6 and the suspense was killing me, so I had to try to wrap my head around the possibilities. Here's my breakdown of the Electoral Count Act & past objections raised during the count.
2/ The Electoral Count Act of 1887 (3 USC sec. 1-21) is confusing, seems to contradict itself & possibly the Const, & is generally problematic. Regardless, I assume that Congress and the VP will attempt to operate under its authority between now & Jan 20.
3/ Article 2 sec 1 of the Const says each state shall appoint, in such Manner (with caps) as the legislature thereof may direct, electors….
4/ This grant of power “trumps” any statutory limits on that power or delegation to another body of that power. So, the state legislatures continue to have the power to direct electors.
