The Ky Supreme Court also overturned an arson & attempted murder conviction because of "flagrant" prosecutorial misconduct by Christian County Commonwealth's Attorney Rick Boling, who is banned from the courthouse now because of the role he played in a controversial Bevin pardon.
The Ky Supreme Court basically says Boling lied to jurors as to whether the defendant was intoxicated. He knew she was, as he had been told by the investigator.
Investigator: "Well, she was out of her frickin’ mind."
Boling: "That’s why I didn’t ask that question (laughter)"
The high court said of this: "The conduct went beyond mere
advocacy and prosecutorial zeal. It was unnecessarily exploitative and dishonest."
