Let's clear the misconceptions of what lawyers do which come from tv.

2. A lawyer upon admission to the bar swears an oath to defend the constitution which constitution provides for the right to legal representation and the presumption that one is innocent until PROVEN guilty. Once a lawyer takes up a case, he has a legal duty to do her best.
3. A lawyer is an officer of the court, and she has a duty to help the court arrive at the truth. However, the burden of proving the guilt of the accused rests on the prosecution. And the standard of proof is "beyond a reasonable doubt".
4. If there are gaps in the evidence or there is evidence that exonorates the accused, defence counsel has a duty to point it out to the Court. Lawyers thus present a case based on what the evidence speaks to. We don’t manufacture evidence. That's professional misconduct.
5. If a lawyer knows for a fact that the client committed the offence, and that doesn't sit well with one's conscience, the lawyer must recuse himself. However, if you take on the case, you have a duty to provide effective representation to your client.
To put it simply, such defence lawyer would be telling the court that "the evidence presented doesn't prove the alleged guilt of the accused beyond a reasonable doubt" and not that "the accused did not do it."
