This last-minute Trump regulation illustrates the complex relationship between frontline discretion and administrative burden. Immigration judges lose discretion about the grounds to accept asylum seekers (“severe harm”), but have more discretion to reject (“frivolous” cases).
Excellent thread here, and a reminder that a good deal of the Trump agenda will be undone because they refused to listen to reasonable concerns of the public. The Administrative Procedures Act of 1946 did more to block authoritarianism than the entire GOP.
