CBC's @cbcfifth fought to have court documents unsealed to find out why Ottawa Police conducted a no-knock raid at Anthony Aust's home. He died after a falling from a 12-storey window on Oct 7. Police were looking for evidence of drugs trafficking & a handgun. No gun was found.
The Information to Obtain a search warrant (ITO) is 17 pages, More than 6 pages are blacked out. It's used to persuade a justice of the peace to sign off on the warrant. The redacted info concerns 3 confidential informants and details like if they were paid, criminal records, etc
What the ITO does show is that the informants told police that Aust was selling drugs and guns from his Jasmine Cres. apartment. Police believe he was using cell phone apps to post ads to sell a handgun. Aust, 23 was out on bail, on house arrest, with a GPS ankle monitor
The ITO didn't reveal that there were children and elderly people living in the home. During the raid, Aust's two half sibling (12, 13yo) his 94 yo grandma, and 68yo stepdad w/ a heart condition were there. So was his girlfriend. Aust was sleeping
The ITO also didn't reveal that OPS was planning to use a no-knock dynamic entry. Aust family lawyer Lawrence Greenspon says police have a responsibility to provide "full, frank and fair" disclosure to the issuing judge in search warrant applications. https://www.cbc.ca/news/canada/ottawa/anthony-aust-ottawa-court-documents-1.5841481
