The lawsuit resulted from a months-old FOIA request for emails, text messages, and other communications from NTIA acting Administrator Adam Candeub, who was recently named to a senior position at the Department of Justice, and others.

From the limited information the agency has provided, it is already clear that Mr. Candeub has been using his personal email to conduct government business.

The FOIA request sought records relevant to NTIA’s Section 230 @FCC petition.

NTIA and the Trump Administration have been trying to turn the FCC into an internet speech regulator.

@AFPfoundation and others have strongly opposed this power grab

This is not the first time Mr. Candeub’s communications and professional conduct have raised questions.

This 2007 FCC IG report focused on Mr. Candeub's behavior while he was a staffer at the agency. It's not flattering.

As my colleague @EricBolinderLaw makes clear

1) The public has a right to know who is lobbying Adam Candeub.

2) FOIA requests are intended to provide the American public with transparency from their officials and this level of evasion is alarming.
