(Thread)There’s a small part of me that believes SCOTUS threw out the Texas lawsuit to boost their credibility for future election cases that may benefit Trump
Trump appointed 3 Justices, all 3 rejected the TX lawsuit, and now even radical Leftists will see them as more credible

Now that we have contested elector slates from multiple battleground states heading to Congress, in addition to other election fraud lawsuits working their way up from @SidneyPowell1 & Trump, SCOTUS will likely rule on other crucial election matters before inauguration day
(3) the TX lawsuit may have been too big of a bite for the court to take all at once
Throwing out election results in multiple battleground states in 1 single ruling would be an unprecedented use of judicial power
SCOTUS decisions are only as enforceable as people agree to them

(4) Remember, the court has no standing army or its own police force. The Executive branch has to enforce on its behalf and the American people need to believe that Justices are making decisions based on law not politics
So what did the court *maybe* do?
Lose to win

(5) I hate the philosophy of “lose to win”, but it’s not unprecedented in SCOTUS history
Madison v Marbury (1803) is the most important decision in SCOTUS history b/c it established judicial review, meaning courts now had the power to strike down unconstitutional laws

On his way out, Adams stacked the courts with appointments to upset Jefferson on his way in
One of the appointments was appealed to SCOTUS, and SCOTUS struck down a law giving it the power to rectify the situation stating the federal law was in violation of the Constitution

This is where they “lost to win”
By striking down a law that aimed to *expand* the court’s jurisdiction beyond what the court itself believed was constitutional, they gave themselves the much more powerful weapon of being the final arbiter of constitutionality in America forever

Now, we have President Trump appointing 3 Justices and pending court decisions that will alter the course of American history
Kavanaugh was sent through the ringer and ACB got RBG’s sear right before the election
They’re portrayed as Trump’s “people” and demonized by media

So by grouping together to strike down a big case for Trump early on, they boost their credibility as impartial justices
Then when a more narrow judicial remedy is needed in these next few weeks that benefits Trump, their words carry more integrity in the eyes of the public

I’m not saying the Court striking down the TX lawsuit is a good thing
It was a gut-punch to Trump’s base
But I am saying we still have many weeks left until this election battle is over and there will be other important cases heard before the Supreme Court
Time will tell
