Pence could count only the GOP electors, and not the Democratic electors, if he chooses to do so. More evidence could have come to light by then. Or, both slates could be considered by Congress. The key section of the Act is 3 U.S.C. § 15. /5
*Both* slates of electors can claim "safe harbor" status. This is key, and will be tested in SCOTUS. That's why the Big, Beautiful Lawsuit that Trump is preparing as we speak, is so important: in an emergency (fradulent machines) both electors can hold safe harbor status. /6
Pence tosses *both* slates of electors out from the disputed states, meaning Trump wins a majority in the Electoral College. Pelosi and the Democrats can try to walk out. /7
