2/3 if gov refuses responsibility companies and their customers are forced into an antagonistic relationship. Barring comprehensive support measures best thing to do is allow companies to operate according to their needs but leave them subject to liability if they screw up.

3/3 “frivolous lawsuits” aren’t a big threat. Anti-SLAPP laws are pretty robust and it’s not mom n pops they wrote the liability exemption for anyway, it’s for deep pocketed corps who want to kill their customers and workers and pick their pockets.
