My understanding is that family and personal status laws in Palestine are Jordanian penal codes that were historically adopted. These penal codes excuse or commute the sentence of male arbitrators of gender based violence on the basis of honor.
Article 340 of Jordanian Penal Code states the following (from “Femicide and the Palestinian Criminal Justice System” by Nadera Shalhoub-Kevorkian):
Article 340 is originally rooted in French penal code (1810) which was adopted by the Ottomans (1858) during the French presence in Lebanon.
The horrific irony is that those against repealing these revolting penal codes are the ones who claim to be defenders of tradition and culture when in reality the law is rooted in colonialism and misogyny.
#JusticeForIsraa isn’t just that her killers never see the light of day again. Justice must also be a complete repeal of the legal mechanisms that enable excuse and exonerate men who commit violence against women.
Edit: The news re release may not be true apparently but the outrage for Israa shouldn’t be put on hold. We should continue seeking full justice. Her killers were initially only supposed to receive 5 years in prison. Even if they serve that term in full its still outrageous.
