Let’s talk about how the 126 @HouseGOP members who signed the treasonous brief to steal the election could actually face consequences in the form of not being seated or otherwise being expelled from Congress (Thread)
Under the U.S. Constitution, Members of Congress may have their services ended prior to the normal expiration of their constitutionally established terms of office by their resignation or death, or by action of the house of Congress in which they belong by way of an “expulsion.”
Article I, Section 5, clause 2, of the Constitution states that a member of Congress may be removed from office before the normal expiration of his or her term by an “expulsion” a formal vote on a resolution agreed to by two-thirds of the members of that body present and voting.
While there are no specific grounds for expulsion in the Constitution, cases in both the House and the Senate have generally concerned those of disloyalty to the United States, or the conviction of a criminal statutory offense which involved abuse of one’s official position.
It is undeniable that the brief filed by these 126 @HouseGOP members meet the criteria for expulsion. While it typically requires the votes of 2/3 of the chamber to expel a member, one could argue that these 126 members are conflicted out of voting on their own expulsion.
In this case, 126 GOP members of Congress would be unable to participate in the vote due to a conflict of interest. This would give Democrats the 2/3 votes necessary to expel these members as it would be 233 votes for expulsion to 70 against (76% is more than 2/3).
If I were @SpeakerPelosi, I would not hesitate to use every ounce of power at my disposal to make the GOP pay a price for betraying our nation and expel these members based on the fact that they have already violated the oaths they would be sworn to take in order to be seated.
Unfortunately, we can agree that this is unlikely to occur. And it will this once again be up to all of us to organize every day for Democratic candidates and make sure every one of these @HouseGOP traitors is replaced in 2022. I’m all in for this fight once we retake the senate.
Once @KLoeffler and @Perduesenate lose on Jan 5th and we regain the senate, McConnell will no longer be able to obstruct legislation. I hope each one of you will join me in committing to making this a reality and then getting every House GOP traitor and senator out of office.
The strongest arguments for not seating these traitors:

1.) They committed an act of sedition that violates their oath to uphold & defend the Constitution

2.) The brief they signed stated that the election results were invalid, meaning none of them legitimately won their seats
Section 3 of the 14th Amendment is also applicable here, as many have noted, which states that no person who has engaged in insurrection or rebellion against the United States shall be a senator or representative in Congress. Enforcing this would mean removing the entire @GOP.
