Trump filed a complaint in intervention in the Texas suit, and his argument claiming a right to intervene was very interesting. He argued that he has an even more direct interest (i.e., STANDING) than Texas to bring this litigation.
Note that lack of standing is the reason the Extreme Court just dismissed the Texas case. So the wheels are turning over there among Trump’s team. Now, the original question, why use a minesweeper. Well, as I indicated, maybe they lucked into it, maybe they didn’t.
All the same, the wheels are turning and the Texas suit bought Trump two benefits. 1 - see what type of ammunition the other side has; if they have any knockdown arguments, facts, or legal authority that you missed. The Defendant States did a poor job of refuting the affidavits
that were attached to the Texas complaint. 2 - which is the bigger reason, is simply more time to develop more evidence to be included in the final, yet to be filed, complaint. Those same experts who prepared affidavits and reports for Texas have probably been continuing to pour
over the data. And, so, Texas suit as minesweeper provided Trump’s people with more time to refine the arguments for a new suit, with additional or revised, ironclad export reports and affidavits that shore up any soft spots in the allegations.
