my friend just reminded me of this thought experiment from Bryan Stevenson -- imagine if, post WW II, Germany had kept the death penalty. Imagine that they still use it today, and disproportionally execute Jewish people, especially those who commit crimes against Christians.
Now imagine that prosecutors defend this by saying that Jews shouldn't sit on capital juries because they don't trust the German government. Imagine if a German high court ruled that statistical evidence of discrimination against Jews is inadmissible in a death penalty case.
You can see where this is going. Imagine how Germany would be viewed on the world stage if this were the case. Now remind yourself of the centuries of enslavement and torture this country has imposed on Black people, and how disproportionately this country executes them.

Like so many other Black men sentenced to death in this country, 11 out of 12 of Brandon Bernard's jurors were white. Imagine Jews in Germany constantly being put to death by all-Christian juries. Rest in power, Brandon.
